A&C Photography Portrait Photography Agreement

This Portrait Photography Agreement ("Agreement") is entered into between A&C Photography ("Photographer") and the individual completing the booking ("Client").

By signing this Agreement electronically or by checking the acceptance box during the booking process, the Client acknowledges that they have read, understood, and agree to be bound by the terms of this Agreement.

  1. Photography Services

A&C Photography agrees to provide portrait photography services as described in the Client's selected booking package and any approved add-ons.

Session details, location, date, time, package selection, and pricing are incorporated into this Agreement through the booking confirmation.

  1. Payment Terms

A deposit of $30.00 is required at the time of booking for all portrait photography sessions.

The remaining balance is due at the beginning of the scheduled photography session unless paid in full during booking.

Accepted payment methods include credit cards, debit cards, PayPal, Google Pay, Apple Pay, Affirm, and cash.

All taxes are included in the listed booking price. No additional sales tax or fees will be added to the quoted package price.

  1. Cancellation and Rescheduling

Clients may cancel or reschedule a session more than twenty-four (24) hours before the scheduled start time without penalty.

If the Client cancels within twenty-four (24) hours of the scheduled session time, the deposit shall be retained by A&C Photography. Any additional prepaid amounts beyond the deposit shall be refunded.

Clients arriving more than twenty (20) minutes after the scheduled session start time may be considered a no-show at the Photographer's discretion.

No-show appointments may be cancelled without refund of the deposit.

  1. Photographer Cancellation

If A&C Photography is unable to perform the scheduled session due to illness, emergency, equipment failure, or other circumstances beyond reasonable control, the Photographer will make reasonable efforts to reschedule the session.

The Client may choose either:

a. A rescheduled session date, or

b. A full refund of all amounts paid, including the deposit.

  1. Weather and Outdoor Cancellation

A&C Photography specializes in outdoor portrait photography.

The Photographer retains sole discretion to determine whether weather conditions, environmental conditions, safety concerns, or other circumstances make a session unsuitable to proceed.

Sessions postponed due to weather or similar conditions may be rescheduled without additional charge.

  1. Location, Travel, and Venue Fees

Any entrance fees, venue fees, parking fees, permits, or attendance costs required for the chosen location shall be the sole responsibility of the Client.

For sessions involving multiple locations, each location must be within approximately fifteen (15) minutes driving distance of the previous location. Travel time between approved locations does not count against the booked session duration.

Standard service areas include King County and Snohomish County, Washington.

Requests outside the standard service area require advance approval and may be subject to additional travel fees or may be declined at the Photographer's discretion.

  1. Client Responsibilities

The Client agrees to arrive on time and cooperate throughout the session.

The quality and quantity of delivered images may be affected by factors including, but not limited to:

  • Client punctuality

  • Client participation

  • Weather conditions

  • Lighting conditions

  • Venue restrictions

  • Crowd levels

  • Behavior of children

  • Behavior of pets

  • Cooperation of other participants

A&C Photography cannot guarantee specific poses, expressions, image quantities, backgrounds, weather conditions, or artistic outcomes.

The Photographer reserves the right to decline any pose, activity, location, request, or situation deemed unsafe, inappropriate, unlawful, or likely to cause damage to equipment or persons.

If a Client or participant becomes disruptive, abusive, threatening, uncooperative, or creates unsafe conditions, the Photographer may immediately terminate the session.

In such circumstances, the deposit shall be retained and any prepaid balance beyond the deposit may be refunded at the Photographer's discretion. A&C Photography reserves the right to refuse future service.

  1. Delivery of Images

Completed galleries will be delivered electronically through Pic-Time.

The Photographer will make reasonable efforts to deliver completed galleries within fourteen (14) calendar days of the session date.

If circumstances beyond the Photographer's reasonable control prevent delivery within this timeframe, the Client will be notified and provided with an updated delivery estimate.

Rush processing services, when purchased, are subject to a target delivery time of seventy-two (72) hours.

  1. Image Selection and Downloads

The Client will receive access to a private online gallery containing all edited images selected by the Photographer for delivery.

The number of high-resolution image downloads included with the session shall be determined by the purchased package and any additional image purchases or gallery upgrades.

Clients may purchase additional image downloads or full-gallery upgrades either during booking or after gallery delivery.

The total number of edited images presented in a gallery may vary based on session conditions, artistic judgment, and other factors. A&C Photography does not guarantee a specific gallery size.

  1. Editing and Artistic Style

The Client acknowledges that they have reviewed the A&C Photography portfolio and are familiar with the Photographer's artistic style, editing techniques, composition preferences, and creative approach.

Editing decisions, image selection, cropping, color grading, retouching, and artistic judgment remain solely within the Photographer's discretion.

Photographs displayed in the A&C Photography portfolio represent examples of previous work. Results may vary depending on location, season, weather, lighting conditions, subject cooperation, and other factors beyond the Photographer's control.

RAW files, unedited images, and source files remain the exclusive property of A&C Photography and will not be delivered.

  1. Revision Requests

The Client may submit one (1) complimentary revision request within fourteen (14) days of gallery delivery.

Revision requests are limited to reasonable adjustments such as:

  • Exposure adjustments

  • Color balance adjustments

  • Minor cropping changes

  • Minor retouching

Requests involving substantial artistic changes, body modification, extensive retouching, compositing, object removal, style replacement, or other advanced editing services may be declined or quoted separately.

  1. Copyright and Usage License

All photographs remain the copyrighted intellectual property of A&C Photography.

The Client receives a non-exclusive, non-transferable personal-use license to:

  • Download purchased images

  • Print purchased images

  • Share purchased images on social media

  • Share purchased images with family and friends

The Client may not:

  • Sell images

  • License images to third parties

  • Use images for advertising

  • Use images for commercial purposes

  • Enter images into commercial publications

  • Transfer usage rights to another party

without prior written permission from A&C Photography.

  1. Artificial Intelligence and Image Manipulation

The Client may not use photographs created by A&C Photography in connection with artificial intelligence image generation systems, deepfake systems, face-swapping systems, commercial machine learning datasets, or similar technologies in a manner that misrepresents the Photographer's work or authorship.

Any commercial AI-related use requires prior written permission from A&C Photography.

  1. Promotional Use and Model Release

Unless the Client affirmatively opts out during the booking process, the Client grants A&C Photography permission to use delivered photographs for:

  • Portfolio display

  • Website content

  • Social media

  • Advertising

  • Marketing materials

  • Business promotion

The Client may opt out of promotional use through the booking system.

  1. Sessions Involving Minors

The booking Client must be the parent or legal guardian of any participating minor.

The parent or legal guardian must remain present throughout the duration of the session.

The Client represents that they possess legal authority to authorize photography of participating minors.

  1. Gallery Availability and File Retention

Online gallery availability is guaranteed for ninety (90) days following delivery.

The Client is solely responsible for downloading and backing up purchased images during this period.

A&C Photography makes no guarantee that photographs will remain available after ninety (90) days.

  1. Limitation of Liability

In the unlikely event that photographs are lost, stolen, corrupted, damaged, destroyed, or otherwise rendered unusable due to equipment malfunction, technical failure, theft, accident, force majeure event, or circumstances beyond the Photographer's reasonable control, the Photographer's liability shall be limited to either:

a. A rescheduled photography session, when practical and agreed upon by both parties; or

b. A refund of all amounts paid under this Agreement.

The choice of remedy shall be at the Photographer's discretion.

Under no circumstances shall A&C Photography be liable for consequential, indirect, incidental, emotional, special, or punitive damages.

  1. Assumption of Risk and Indemnification

The Client voluntarily participates in outdoor photography sessions and assumes the ordinary risks associated with outdoor locations, including uneven terrain, weather conditions, wildlife, insects, vegetation, traffic, water features, and other natural or man-made hazards.

The Client agrees to release and hold harmless A&C Photography, its owners, employees, contractors, and representatives from claims arising from ordinary risks associated with participation in the session.

  1. Force Majeure

Neither party shall be liable for delays or inability to perform caused by events beyond reasonable control, including but not limited to severe weather, wildfire smoke, natural disasters, government restrictions, public emergencies, acts of terrorism, labor disputes, utility failures, or other force majeure events.

  1. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Washington.

  1. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, understandings, or representations.

Any modifications to this Agreement must be made in writing and agreed to by both parties.
